The Personal Data Protection Law was adopted by the Grand National Assembly of Türkiye on 24 March 2016 and entered into force upon publication in Official Gazette No. 29677 of 7 April 2016. It binds every person and organisation that processes data, with the aim of keeping personal data confidential, protecting it and preventing unauthorised use. Our Company is subject to this Law, and personal data processed in all our operations is protected accordingly.

Personal data

Any information relating to an identified or identifiable natural person, such as name, phone number, email address, photograph or voice recording.

Processing

Any operation performed on personal data: obtaining, recording, storing, altering, organising, disclosing, transferring, classifying, archiving and the like.

Data subject

The natural person whose personal data is processed.

Data controller

The person who determines the purposes and means of processing and is responsible for setting up and managing the filing system. Our Company is the data controller for the data of our customers, visitors and employees.

Data processor

A natural or legal person who processes personal data on behalf of the data controller, under its authority.

When you use the forms on the Site, or contact us by email, phone or WhatsApp, the following data may be processed:

Identity

First name, last name.

Contact

Email address, phone number.

Customer transaction

Your company, industry, the product group or product you are interested in, subject of your request, message content and technical details you share (fluid, flow rate, pressure, etc.).

Transaction security

Date and time the form was sent; technical logs such as IP address, browser and device information kept automatically by the infrastructure hosting the Site.

Your personal data is collected electronically, partly by automated means, when you fill in and send the Contact or Get a Quote forms on the Site, or contact us by email, phone or WhatsApp. Form details are delivered to the Company’s email address and stored in the Company’s email and archive systems.

• receiving, assessing and responding to your contact and quote requests;
• identifying the right product and solution and preparing and sending quotes;
• carrying out communication, sales and after-sales support activities;
• tracking requests and complaints;
• conducting activities in compliance with the law and ensuring information security;
• where you are our customer, collecting and evaluating suggestions to improve our business processes.

Your personal data is processed on the following legal bases under Article 5 of the Law:

• processing is necessary for the establishment or performance of a contract with you (quote request and subsequent sales process);
• processing is mandatory for the data controller to comply with a legal obligation;
• processing is necessary for the data controller’s legitimate interests, provided this does not harm your fundamental rights and freedoms (request tracking, information security);
• where none of the above applies, your explicit consent given by ticking the consent box on the forms. If you do not give consent, data within this scope is not collected or processed.

Your personal data may be shared with the following recipients, for the purposes above and only to the extent necessary:

• our authorised employees handling your request and the shareholders managing the Company;
• manufacturers we represent, where a technical assessment is needed for your quote (limited to the technical details your request requires);
• our business partners providing hosting, email and form delivery services for the Site;
• legally authorised public authorities, upon request.

The Site’s hosting infrastructure and the servers of some service providers may be located outside Türkiye. Technical logs and form data arising from these services may be transferred abroad in accordance with the procedures and conditions set out in Article 9 of the Law.

Your personal data is kept for as long as the purpose of processing requires and the relevant legislation prescribes. Once this period ends or the conditions for processing no longer apply, it is erased, destroyed or anonymised in line with our Personal Data Protection and Destruction Policy.

Nortes Mühendislik takes the utmost care to apply its written policies so as to fully meet its obligations under the Law, and takes all necessary administrative and technical measures to prevent unlawful processing of and access to personal data and to keep it secure.

Under Article 11 of the Law, you may apply to the Company to:

• learn whether your personal data is processed;
• request information if it has been processed;
• learn the purpose of processing and whether the data is used in line with that purpose;
• know the third parties in Türkiye or abroad to whom your data is transferred;
• request correction of incomplete or inaccurate data and notification of the correction to third parties to whom it was transferred;
• request erasure or destruction of your data once the reasons for processing no longer exist, and notification of this to third parties to whom it was transferred;
• object to a result against you arising solely from automated analysis of your data;
• claim compensation for damage arising from unlawful processing of your data.

You may submit applications regarding your rights, in line with the Communiqué on the Procedures and Principles of Application to the Data Controller, by one of the following means:

• in writing with a wet signature, in person or through a notary, to Ballıoğlu İş Merkezi, Alipaşa Mah. Sülün Cad. No: 6/1 Kat: 3 Ofis: 306 59850 Çorlu/Tekirdağ;
• via registered electronic mail (KEP), secure electronic signature or mobile signature;
• by email to info@nortes.com.tr from the email address registered in our records.

Your application should include your full name, Turkish ID number (nationality and passport number for foreign nationals), address for notification, email and phone if any, and the subject of your request. It will be concluded free of charge as soon as possible and within thirty (30) days at the latest, depending on its nature; if the action requires an additional cost, the fee set by the Personal Data Protection Board may apply.
